How to Handle SORB Cases

This evening program for judges will address handling cases involving the Sex Offender Registry Board (SORB) in the Superior Court.

The agenda will include the following topics:

  • An introduction to (and brief primer on) the SORB
  • Injunctive relief – motions to prevent/stay dissemination of Level 2 and 3 Final Classification
  • SORB c. 30A review & the “clear and convincing evidence” standard
  • Sex Offender reclassification: who has the right to request it and when? Who has the burden of proof and what standard applies?
  • If the court vacates a SORB classification decision, who reclassifies the petitioner – the court or SORB?
  • Sample SORB decisions on current issues

There will be time for Q&A and discussion with your colleagues. Although designed for newer Superior Court judges, experienced judges are also invited (and welcome) to attend.
