Self-Represented Litigants in the Courtroom: Managing in the Gray Areas

Throughout the Commonwealth, the large number of cases involving self-represented litigants presents a great challenge and new reality for judges. This half-day program for judges will focus on the practical challenges and ethical considerations posed by self-represented litigants. Where are the lines? How far should a judge go when one side is represented by counsel and one side is pro se? Should a judge provide information to self-represented litigants about claims and defenses?

There will be panel discussion on judicial discretion and the Judicial Guidelines for Civil Hearings Involving Self-Represented Litigants, as well as what can be learned from the experience of the Commission on Judicial Conduct. In addition, participants will discuss perplexing hypothetical scenarios with one another.

This program is “a must” for new judges in court departments especially impacted by self-represented litigants. It will also serve as an opportunity for experienced judges to strategize and discuss best practices with colleagues.
