This half-day program for Massachusetts judges will focus on a variety of practical issues related to jury management in both civil and criminal cases, such as:

  • Approaches to impanelment
  • Conducting individual and lawyer voir dire
  • Problematic challenges based on race or gender (Batson and Soares decisions)
  • Excusing jurors
  • Sleeping, inattentive or disgruntled jurors
  • Giving instructions to the jury
  • Jury questions during trial and deliberation
  • Deadlocked juries
  • Speaking to the jury pool at the start of the day, prior to impanelment, and to a jury after a trial is over
