Issues Involving Individuals with Diminished Capacity (Zoom Program)

As judges, we encounter individuals with diminished capacity nearly every day. Whether the person is a litigant, witness, juror or accompanying family member, we must navigate issues of accommodations, communication challenges and competence.

Understanding that these issues arise in each Department of the Trial Court, this three-hour Zoom program will explore how judges and clinicians assess capacity (to stand trial, to testify, to make financial and personal decisions) and how judges respond to scenarios in which these individuals appear in our courts. Attendees will learn about guardianships, alternatives to guardianships, and accommodations.

Panelists will include experts in the field of mental disability law, a forensic psychiatrist, and District and Probate Court judges.
