FJI President & Dean to Deliver Lecture on the Balance Between Federal Law and State Autonomy

As the landscape of federal constitutional law undergoes rapid transformation, state courts are navigating an increasingly complex legal environment. In the upcoming 8th Annual Richard S. Milstein Lecture (MCLE), the Honorable Scott L. Kafker, Associate Justice of the Massachusetts Supreme Judicial Court and President & Dean of the Flaschner Judicial Institute, will explore the evolving dynamics of judicial federalism.

Justice Kafker will examine the growing emphasis on state courts’ independent interpretations of their own constitutions, and how these developments interact with recent shifts in U.S. Supreme Court jurisprudence. His lecture will also address changing advocacy strategies, emerging theories in state constitutional law, and the broader design of American federalism – a system rooted in dual sovereignty, with shared and sometimes competing responsibilities to safeguard individual rights and prevent governmental overreach.

Moderated by Jaclyn L. Kugell, Esq., MCLE Trustee and partner at Morgan, Brown & Joy LLP, this timely and thought-provoking lecture promises valuable insights for anyone interested in constitutional law, federalism, and the role of state courts in protecting civil liberties.
