MBF Board Approves Two-Year IOLTA Grant for Flaschner

The Trustees of the Massachusetts Bar Foundation recently voted to renew funding for the Flaschner Judicial Institute.  The new two-year IOLTA grant award will continue to fund educational programs for Massachusetts judges through June 30, 2013.

This grant continues to demonstrate the MBF's belief in the importance of an independent source of judicial education to strengthen the administration of justice in the Commonwealth.  MBF President, Joseph P.J. Vrabel, Esq., wrote "On behalf of the MBF Trustees, I would like to thank [Flaschner] for all of your outstanding work in providing exemplary educational programming for the Commonwealth's judiciary."  Since 1982, the MBF has provided critical financial support to the Flaschner Judicial Institute.

Just Released:  The 2011 Edition of the Massachusetts Guide to Evidence

In collaboration with the the Supreme Judicial Court Executive Committee on Massachusetts Evidence Law, the Flaschner Institute is pleased to announce the release of the 2011 official print edition of the Massachusetts Guide to Evidence.

The Supreme Judicial Court recommends the use of the Guide.  The new 2011 edition is available on the Supreme Judicial Court, Appeals Court, and Trial Court websites at:  www.mass.gov/courts/sjc/guide-to-evidence.

The Flaschner Judicial Institute has provided a complimentary printed copy of the Guide to all active trial and appellate judges in Massachusetts. For ordering information, please click here.

The 2011 Edition of Massachusetts Motor Vehicle Stops Benchbook Now Available

The Flaschner Judicial Institute is pleased to announce the release of the 2011 edition of the Massachusetts Motor Vehicle Stops Benchbook. The revised edition was written by James F. Comerford, Esq., and approved by an editorial committee which included: Hon. John M. Greaney (ret.), Supreme Judicial Court; Hon. Kevin J. O'Dea, District Court; and Daniel W. O'Malley, Esq.

The 2010 Edition of the Massachusetts Guide to Evidence Now Available

The Flaschner Judicial Institute is pleased to announce the release of the 2010 official print edition of the Massachusetts Guide to Evidence. To view the press release issued by the Supreme Judicial Court and its Executive Committee on Massachusetts Evidence Law, please click here.

The Supreme Judicial Court recommends the use of the Guide.  The new 2010 edition (480 pages) is available on the Supreme Judicial Court, Appeals Court, and Trial Court websites at:  www.mass.gov/courts/sjc/guide-to-evidence.

The previous edition of the Guide was revised to reflect changes to Massachusetts evidence law that occured  between October 1, 2008 and December 1, 2009.  These updates include discussion of over 30 decisions issued in 2009 by the Supreme Judicial Court, Appeals Court, and the federal courts that defined or clarified issues, including the U.S. Supreme Court case of Melendez-Diaz v. Massachusetts.

There are four new sections (including one on the Lampron-Dwyer protocol for access to third-party records prior to trial), and detailed notes on a wide variety of new topics, including successive complaints, impounding versus sealing, production of privileged records from non-parties, prior inconsistent statements, confrontation in criminal cases, etc.

The Law of Homicide in Massachusetts Now Available

An exciting, new publication for judges and attorneys is now available.  The Law of Homicide in Massachusetts, written by Hon. John M. Greaney (ret.) and James F. Comerford, Esq. is a 344-page benchbook that covers the substantive law of homicide (malice, felony-murder, manslaughter, aiding and abetting, etc.), as well as Miranda and other confession issues, defenses (including self-defense and lack of criminal responsibility), expert testimony, forensic testing, witness immunity, the Confrontation Clause, jury issues, closing arguments and appeals.

"It is a useful, unique, and much-needed guide," said Flaschner Judicial Institute Executive Vice President Robert J. Brink.  "It also fills a gap in the literature."

New FJI Officers and Trustees Elected

The Flaschner Judicial Institute has elected new Officers and Trustees to its Board of Trustees.  By a unanimous board vote, Hon. Judith A. Cowin, Associate Justice of the Supreme Judicial Court, will serve as Chairperson of the board.  Hon. Margot Botsford, Associate Justice of the Supreme Judicial Court, will serve as President and Dean.  Richard D. Dionne, Esq., of Dionne & Gass LLP, will continue to serve as Treasurer and Clerk.  Robert J. Brink, Esq., Executive Director of the Social Law Library, will also continue to serve as Executive Vice President, Assistant Treasurer, and Assistant Clerk.

 

In addition, the following seven trustees were also newly elected:  Hon. John J. Curran, Jr., First Justice of the Leominster District Court; Hon. Kenneth Desmond, Jr., Associate Justice of the Dorchester Division of the Boston Municipal Court; Hon. Dina E. Fein, First Justice of the Western Division Housing Court; Hon. Stephen M. Limon, Associate Justice of the Suffolk County Juvenile Court; Hon. Christine M. McEvoy, Associate Justice of the Superior Court; Hon. Gordon H. Piper, Associate Justice of the Land Court, and Hon. Catherine P. Sabaitis, First Justice of the Plymouth Probate & Family Court.

 

The 16-member board was expanded to include representatives from every division of the Trial Court and both the Appeals Court and Supreme Judicial Court.  For a complete list of board members, please click here.

Official Print Edition of the New Massachusetts Guide to Evidence Now Available

The Supreme Judicial Court and its Advisory Committee on Massachusetts Evidence Law recently announced the release of the Massachusetts Guide to Evidence, and the Supreme Judicial Court recommends the use of this Guide.

The Massachusetts Guide to Evidence assembles existing Massachusetts evidence law in an easy-to-use document organized similarly to the Federal Rules of Evidence. The Guide includes extensive explanatory notes and citations to pertinent authorities.

Massachusetts Bar Foundation Trustees Vote to Continue Major Funding for Flaschner

The Trustees of the Massachusetts Bar Foundation recently voted to renew funding for the Flaschner Judicial Institute.  The new three-year IOLTA grant award will continue to fund educational programs for Massachusetts judges through 2011.

This grant continues to demonstrate the MBF's belief in the importance of an independent source of judicial education to strengthen the administration of justice in the Commonwealth.  Since 1982, the MBF has provided critical financial support to the Flaschner Judicial Institute.  "We take enormous pride in the investment the MBF continues to make in judicial education and in our organization," said Hon. John M. Greaney, FJI President and Dean.

Flaschner Unveils New Website

The Flaschner Judicial Institute recently launched this new website that features a calendar of programs, a list of Flaschner publications, an online suggestion box, and much more!  Please feel free to share feedback and/or any ideas you might have with the Flaschner staff.
